Definitions
"Equilibrium" means Equilibrium Associates Limited.
"Customer" means any individual or Company who purchased training or attended training given by or on behalf of Equilibrium.
"Delegate" means any individual who is to attend a training course and is either the customer itself or is nominated by the customer

Payment Options
We can accept Visa and Master-card credit cards and payments by Switch/Visa Delta. We do not accept American Express.

You can also make payment by cheque, payable to ‘Equilibrium Associates Limited.' Cheques must be received and cleared through our bank account in advance of attending an Open Course.

You may also transfer money direct to our bank account (pounds Sterling only). Account name: Equilibrium Associates Limited, Sort Code: 80-11-00 Account number 00280018.

For direct bank transfer, all charges to be paid by sender.

In the event of late payment, we reserve our statutory right to interest at the rate of 8% above base, under the Late Payment of Commercial Debts (Interest) Act 1998.

Fees:
Fees quoted cover consultancy and training costs and exclude accommodation and travel costs. Fees are subject to VAT where applicable, which applies to all delegates attending UK courses. Course fees must be paid in full prior to delegate attendance. Invoices relating to in-house training are payable within 7 days of issue of invoice.

Training Course Cancellations/Rescheduling

Requests to cancel or reschedule training must be made in writing (by e-mail), followed by a telephone call. Cancellation fees are as follows:-

In-House Training/Consultancy
Less than 1 week's notice 100% of course fee is payable
Less than 2 weeks & more than 1 week 75% of course fee is payable
Less than 4 weeks & more than 2 weeks 50% of course fee is payable
More than 4 weeks notice no fees are payable

The customer will be liable for any travel or accommodation expenses which have been incurred even if the course is cancelled with more than 4 weeks notice.

Open Courses
If a delegate is unable to attend, it is acceptable for a substitute delegate from the same company to take their place, at no additional cost. A course booking is taken as firm once verbal/written confirmation or payment has been received from the client.

Changes to Services
Equilibrium Associates Limited retains the right to make any changes or cancellations to any part of its advertised services .Also, the price, date and location may change from that advertised. These changes will not affect your statutory rights. Equilibrium will not be responsible for any consequential loss of expense incurred by the candidates.

Refunds
Normally these are made by the same method used for payment or as may be agreed. The decision as to which course of action will be taken will be agreed between Equilibrium Associates Limited and the client to mutual satisfaction.

Insurance
Equilibrium Associates Limited are covered by employers liability insurance.

Force Majeure
We are not liable for any delay of failure to fulfil any order due to events beyond our control.

Data Protection:
We are registered with the UK's Data Protection Registrar and so follow their guidelines and abide by their rules.

Bulk email Policy
We respect our customers' right to privacy and therefore we do not solicit business by any methods involving Unsolicited Commercial Email (UCE) also known as spamming.

Applicable Law / Courts of Jurisdiction
Scotland.

Retention of Title
Intellectual property remains the property of Equilibrium Associates Limited.

Liability
All information, products and services provided on this Web site are provided in good faith and are warranted as accurate as far as is possible. We do not accept liability for the buyer's actions or decisions based on the information, products or services provided. Liability, however arising, is limited to the replacement of goods supplied and paid for.

Equilibrium Associates Limited shall not be liable for failure to perform its duties due to illness, death, accident and third party default or for any other reason outside of Equilibrium Associates Limited's reasonable control.
